Nick Carter said he was 2,500 miles away from his accuser Ashley Repp on one of the dates she claims he sexually assaulted her, Us Weekly can exclusively report. Repp said in her lawsuit the dates provided were estimates. On Wednesday, January 7, the Backstreet Boys star filed court docs demanding Repp's claims be thrown out. Repp sued the pop star in 2023, over three alleged sexual assaults that she claimed took place in 2003 when she was 15. (In her initial suit, Repp said the dates of the alleged assaults she provided were "approximations" and that the alleged assault occurred "on or about" that date.) Carter, 45, adamantly denied the accusations. His lawyers point out that Repp told law enforcement in 2004 that she had "deceived Carter and others about her age and admitted that her sexual encounters with Carter were consensual." The singer believes his two other accusers, Shannon Ruth and Melissa Schuman, are conspiring with Repp, to make false accusations in an attempt to force a financial settlement. In his new filing, Carter said Repp, who he called "desperate for money and attention," claimed one of the assaults took place on October 27, 2003, on a yacht in Marathon, Florida. Even during her deposition, Repp was adamant that she was violently sexually assaulted by Carter on October 27, 2003 and that it was 'absolutely not' possible that this date was incorrect." The singer's lawyer said this is not possible since Carter was not in Florida that day. "Rather, on October 27, 2003, Carter was over 2,500 miles away from Florida attending the 2003 Radio Music Awards in Las Vegas, Nevada." The Backstreet Boys' legal team said Carter was photographed at the show and the day before the event. Carter's team said Repp froze when presented with this evidence at her deposition. Nick Carter's Accuser Demands 7-Figure Payout to Drop Sexual Assault Claims When asked how the assault could have happened with Carter in Vegas, Repp said, "Again, I was almost certain that the date was October 27, 2003. . . . It is quite possible that I may have gotten that date incorrect." Carter's lawyer responded, "Ms. Repp, you've testified for almost an hour about October 27, 2003, being the date in which Nick Carter sexually assaulted you." When pressed further, she responded, "I'm not changing my testimony that I was sexually assaulted a third time. I will agree that I am not perfect. And, you know, I've been fairly good with getting exact dates correct." His lawyer added, "Ultimately, Repp conceded that it was impossible for Carter to have assaulted her on October 27, 2003, as she had alleged in her Complaint, and confirmed in sworn testimony many times since." Nick Carter's Accuser Speaks Out Against His New Claims As a result, Carter asked that all of Repp's claims against him - sexual battery, intentional infliction of emotional distress and negligent infliction of emotional distress - be thrown out of court. In her initial lawsuit, Repp claimed Carter had "continued to engage in sexual intercourse with [Repp] despite her repeated refusals and requests for him to stop." Carter denied the claims. His legal team portrayed Repp as a Backstreet Boys and Carter fan. His lawyer said, "[Repp's] friends have all testified that [Repp] deliberately lied to [Carter] and his family about her age," the filing read.
