Diddy's legal team is still determined to get him out of jail ASAP, even going as far as to now point fingers at the judge! On Tuesday night, the disgraced rapper filed a new appeal and demanded his conviction be overturned. He wants to be released from prison - or his sentence lightened, at least. As we previously reported, Diddy was convicted on two counts of violating the Mann Act, transporting individuals for the purpose of prostitution. He was acquitted of the far more serious charges: sex trafficking and racketeering. However, he only got 50 months earlier this year. That's 4 years and 2 months, plus an extra twenty-something days because he got caught violating prison rules by making hooch. Diddy has been fighting the sentencing, though. The music mogul has filed multiple appeals, but he is singling out Judge Arun Subramanian this time around! TMZ reported that he claimed that the judge acted like a "thirteenth juror" in the criminal trial. His lead appeal attorney, Alexandra Shapiro, alleged Judge Subramanian's "draconian" 50-month sentence is based on the conduct the jurors acquitted Diddy of, specifically the racketeering and sex trafficking charges. Hmm... Shapiro went on to claim Subramanian incorrectly said he could consider Diddy's behavior related to the more serious charges at the sentencing, even though he was acquitted of them. According to the attorney, that is a violation of Diddy's constitutional rights. So, he and his legal team believe his sentence should only be based on the two counts of violating the Mann Act and want either him released from jail or his sentence lightened. His legal team wrote, per ABC7 Los Angeles: "Defendants typically get sentenced to less than 15 months for these offenses - even when coercion, which the jury didn't find here, is involved. The judge defied the jury's verdict and found Combs 'coerced,' 'exploited,' and 'forced' his girlfriends to have sex and led a criminal conspiracy. These judicial findings trumped the verdict and led to the highest sentence ever imposed for any remotely similar defendant." During the sentencing, Subramanian did say that when figuring out the prison term, he considered Diddy's treatment of two former girlfriends, including Cassie Ventura, who testified that the Bad Boy Records founder beat them and coerced them into having sex with male sex workers. He said he "rejects the defense's attempt to characterize what happened here as merely intimate, consensual experiences, or just a sex, drugs, and rock 'n' roll story," adding: "You abused the power and control that you had over the lives of women you professed to love dearly. You abused them physically, emotionally, and psychologically. And you used that abuse to get your way, especially when it came to freak-offs and hotel nights." Federal prosecutors have a couple of months to respond before the case can go before the appellate court, but they likely won't let him get away with this latest attempt to go free.
