Alec Baldwin was called out for making an appearance at a taping of Dancing with the Stars to watch his wife, Hilaria Baldwin, perform while refusing to appear for a deposition over the Rust shooting, Us Weekly can report. On November 12, a lawyer for Serge Svetnoy, a gaffer on the 2024 film who has been attempting to take Alec's deposition since March, wrote, "In every instance, [Alec and the other defendants] claimed to be unavailable or simply refused to testify." Svetnoy claimed there have been multiple postponements due to the actor's "requests for professional accommodations." The gaffer pointed out that "despite claiming to have work commitment throughout most of September 2025, Alec, 67, would travel to and appear in Los Angeles, California, at the taping of an episode of Dancing With the Stars to support his wife." (Alec's wife, Hilaria, was the fourth contestant eliminated from season 34 of DWTS on October 7.) He said he did not feel he needed to appear for multiple depositions. Svetnoy's lawyer added, "What has [Alec] done in the past 6 months to move this deposition forward? [Svetnoy] has been patient and has cooperated with [Alec's] counsel at every turn. This cannot be disputed. But as the saying widely attributed to Albert Einstein goes, 'The definition of insanity is doing the same thing over and over and expecting different results.' Alec, who was a producer on the western, was accused of causing the gaffer emotional distress. Svetnoy said he was traumatized after seeing his friend Halyna Hutchins fatally shot during production. Alec was holding the gun when it was fired but denied pulling the trigger. The gun was not supposed to have real bullets loaded in it. Alec denied all allegations of wrongdoing in the civil matter and in a criminal case brought against him. The criminal charges filed against Alec were dropped in July 2024 after the court determined there had been alleged misconduct by prosecutors. In the civil lawsuit, Svetnoy said he experienced "emotional distress" from seeing Hutchins die and the bullet almost striking him. In court documents filed by Alec's team, his attorney said, "An accidental shooting took the life of cinematographer Halyna Hutchins on a movie set just outside of Santa Fe, New Mexico." The duo filed claims against Alec and the film producers, which the actor settled. Alec said the settlement should have resolved the incident, but then Svetnoy sued him. Alec's lawyer said, "Svetnoy filed this lawsuit, alleging injuries based solely on his being close by when the prop gun went off and the live round - which should not have been in the gun and for which those responsible for it had just told Mr. Baldwin that it was unloaded - traveled in front of [Svetnoy]."
