Hmm. This is a bit... unexpected... Justin Baldoni's been digging up a lot of new dirt against Blake Lively as he continues to fight her sexual harassment lawsuit, but this?? We didn't see coming from him! According to TMZ on Monday, Justin's production company Wayfarer just filed an exhibit in the legal dispute, including a new video taken in between scenes of It Ends With Us. In the clip, Justin, Blake, and Jenny Slate are hanging out in a bar set while waiting to shoot a scene. At one point in the lengthy video, the Jane the Virgin alum says "sexy" while looking in Blake's direction, adding: "I think it's pretty hot. Sexy." He seemingly then told Blake she had something in her teeth and called for a "toothpick." After, he reportedly said something unintelligible about Jenny before turning to her, saying: "Sorry, I missed the sexual harassment training." And then he looked at the camera and gave a big eye roll! Some nearby apparent crew members who overheard the "sexy" comment also seemed to be visibly uncomfortable about the comment. Watch the shocking evidence (below): In the filing, Justin's team tried to paint the picture that the actor never meant any harm on set. They even detailed his (poor) attempt at apologizing "if his remark was inappropriate." A couple minutes after the initial comment, he added while chatting with the women: "Well, my apologies." And the Gossip Girl star apparently replied (though you can't hear it in the recording): "All good." So, we guess they think it proves there was no harm done if Blake was so chill with it?? Baldoni's lawyers also claim his use of the word "sexy" "was entirely unremarkable" because Blake was "not scantily clad" - she was wearing a fleece onesie, as all the major actors in the scene were. The legal team elaborated: "Nor was this anything that might remotely approach flirtation - rather, both she and Baldoni were working at the time, surrounded by actors and crew. Baldoni's expression was neutral and not ogling or suggestive." So, what? It can't be sexual harassment if a woman isn't wearing something super revealing? It doesn't matter if a girl's made to be uncomfortable by a man's unwanted opinion on her body because she's not wearing a conventionally "attractive" outfit or he doesn't sound flirty enough?? What kind of argument is that? Just saying! The lawyers added in his countersuit that "Lively herself set the tone for personal discussions on set, including what language was acceptable," and that she "had no issue using the word 'sexy' herself, but apparently took note both times Baldoni said the word in her presence." Justin has been accused of sexual harassment on set, so seeing him brazenly joking about it isn't a good look. Plus, Lively's amended complaint accuses Wayfarer Studios of having "failed to provide Ms. Lively with even rudimentary employment protections, such as an employee handbook, sexual harassment policy, information or any training on sexual harassment, discrimination, or respectful workplace expectations." That said, despite his joke, the filmmaker testified in his deposition in early October that he had participated in anti-discrimination, anti-harassment and anti-retaliation training during production of the Colleen Hover movie. Yet it was still a laughing matter to him... It's hard to see why he thought it was a good idea to submit this to court! People on Reddit, for instance, don't see any redeemable qualities about it, saying: "I'm struggling to work out what is the worst moment.
