A 4-year-old tragically passed away in a freak accident earlier this year... now his family has filed a wrongful death lawsuit. Life changed forever for the Kerr family in June when father Cathal and his two sons Charlie, 7, and Ronan, 4, went to play at the Villa La Jolla Park in San Diego. Unbeknownst to Cathal and Charlie, that would be the last time they ever got to go to a park with little Ronan. According to a wrongful death lawsuit filed by the family and seen by the San Diego Union-Tribune, the three Kerr boys were playing in the park when a massive, 34-foot-long eucalyptus branch snapped off a tree and plummeted down 60 feet. Cathal attempted to grab his two young sons to flee the area, but he could not get to Ronan in time and the branch came crashing down on his head. The young boy was rushed to Rady's Children Hospital, where he was treated for life-threatening injuries, including facial lacerations, multiple broken bones, and a traumatic brain injury. Cathal also sustained facial injuries. And tragically, Ronan died from his injuries at the hospital seven days later. So heartbreaking. You can see images from the accident (below). They specifically named two contractors and claimed the tree from which the branch fell was unhealthy and had deadwood: "The tree's branches and limbs were large, elongated, heavy, angled and improperly maintained to the point that it was obvious to a trained eye that the tree would catastrophically fail." The suit lists more than 30 instances between 1983 and 2005 of tree branches and eucalyptus trees falling in the city, including in Villa La Jolla park. One instance includes a 4-year-old girl killed in '83 at the entrance of the San Diego Zoo: "Eucalyptus trees in San Diego parks were posing significant dangers to the public. The city's inspection and maintenance protocols were grossly inadequate to identify hazardous trees before they failed." The suit is seeking both financial damages AND for all eucalyptus trees to be inspected - and any deemed dead or damaged be maintained or removed. Additionally, the family wants all assessments to be made public on the city's official website. In an obituary, Ronan's family remembered the young boy as "a bright light" who was "full of heart, humor, and boundless curiosity." They added: "His hugs, his giggles, the way he melted into you when he snuggled - these are the things that will echo forever in the hearts of those who loved him. Ronan may have only been here for 4.5 years, but he lived with a presence that felt bigger than life. He changed us.
