Sia's split from her estranged husband, Daniel Bernard, is getting messy.
According to legal documents obtained by a news outlet on Tuesday, October 28, Bernard, 47, requested full custody of the couple's 1-year-old son, Somersault Wonder Bernard, alleging the singer, 49, is a "serious and immediate danger" to their child.

"Sia is an unfit and unreliable parent struggling with substance abuse and addiction, rendering her incapable of providing safe or stable care for Summi," Bernard wrote, per the legal docs. "I am the only safe and reliable parent for our son. I am a doctor, young, healthy, and have no criminal history or drug or alcohol addiction issues."Bernard also wants to require his ex to submit to random and regular drug testing and limit her to two-hour professionally monitored visits, three times per week, with their son. He claimed his estranged wife hid a two-week hospitalization in Los Angeles, where she tested positive for barbiturates and benzodiazepines.

The "Unstoppable" songstress responded by claiming there's "no emergency reason" her ex should be granted full custody, as their son "has been and remains safe in her custody" since their separation. In addition, she pointed to an agreement the former couple made in August to only allow Bernard "very restricted professionally monitored visits" as she learned he was under investigation by the LAPD and DCFS over "illicit child pornography" allegedly found on his computer's hard drive.
Bernard denied any involvement in the child pornography investigation, which has now been ruled inconclusive and closed. He accused Sia of "planting evidence" to restrict his time with their son.

The singer also responded to the claims about her drug use, insisting she's been sober for over six months. "Dan's attempt to weaponize my past sobriety journey... serves no legitimate purpose and is intended only to distort the facts and undermine my credibility," she said, calling sobriety a "cornerstore" of her life. Sia filed for divorce from Bernard in March after nearly two years of marriage. The singer cited "irreconcilable differences" for the split and requested the court be barred from awarding spousal support to Bernard.
