Joshua Jackson and his estranged wife, actress Jodie Turner-Smith, called off their divorce trial over custody issues, Us Weekly can report. On Tuesday, October 14, Turner-Smith's legal team filed court docs requesting that the trial scheduled to begin on October 15, be taken off the court's calendar. Turner-Smith, 39, said she worked out a deal with Jackson, 47, to hash out a custody deal for their daughter outside of the courtroom. The Tron: Ares actress' lawyer wrote, "[Turner-Smith and Jackson] are in the process of negotiating a custody judgment. The parties will return to the [a private judge they hired] to resolve any impasses in the proposed custody judgment." The exes share a daughter named Juno. In her initial petition, Turner-Smith requested joint custody of their children and asked that neither party be awarded spousal support. In May, the exes briefly came to an agreement. However, things turned a bit contentious when they were unable to agree on which school their daughter should attend. Jackson didn't agree with Turner-Smith's choice of school or her proposal that their daughter spend a lengthy amount of time with her, without any breaks, while she was working overseas. Joshua Jackson, Jodie Turner-Smith Attended Event 1 Day Before Separation In a letter he wrote to his ex, Jackson explained, "I don't think it's good for Juno to go for as long as you have proposed without seeing either parent, whenever it is reasonably possible for us to avoid without putting undue stress on Juno." He added, "I think that maximizing that frequent, continuing and meaningful contact should be our guiding light through all of these conversations and planning of parenting time. Juno needs both of us. Ideally exactly equally." In the letter, Jackson also objected to Turner-Smith's planned trip to Morocco. Us obtained a letter that Turner-Smith wrote to Jackson about her proposal. Turner-Smith told Jackson she appreciated his point of view and was "glad we agree that our shared goal is to provide Juno with as much stability, consistency and meaningful time with both of us as possible." Turner-Smith said her proposed trip, " allows Juno to enjoy a true sense of continuity and presence - something we both value. She's excited about our travel plans, and I believe this stretch of time will allow her to feel deeply grounded and connected during a season that's naturally more open and flexible. The divorce has had no movement until Turner-Smith informed the court the trial was off the day before it was scheduled to begin. For his part, Jackson has been busy in New York filming a new movie Happy Hours with Katie Holmes. On September 22, Jackson, Holmes and other Dawson's Creek alums appeared for a reunion at New York's Richard Rodgers Theatre.
