Prince Williams / WireImage On Oct. 9, a federal judge threw out Drake's defamation lawsuit against UMG, ruling that the company can't be held responsible for promoting Kendrick Lamar's five-time Grammy award-winning diss track "Not Like Us." Gregory Shamus / Getty Images The US district judge, Jeannette Vargas, determined that the song's lyrics contain a "non-actionable opinion" and are not considered defamatory. UMG "The issue in this case is whether Not Like Us can reasonably be understood to convey as a factual matter that Drake is a pedophile or that he has engaged in sexual relations with minors," according to the court documents. "In light of the overall context in which the statements in the recording were made, the court holds that it cannot." In response to the court's ruling, a UMG spokesperson said the following in a statement provided to Variety: "From the outset, this suit was an affront to all artists and their creative expression and never should have seen the light of day. We're pleased with the court's dismissal and look forward to continuing our work successfully promoting Drake's music and investing in his career." Simone Joyner / Getty Images According to a statement obtained by The Guardian, a rep for Drake said, "We intend to appeal today's ruling, and we look forward to the court of appeals reviewing it." Michael Owens / Getty Images While both are technically under the Universal Music Group, Drake accused UMG of promoting "Not Like Us" through secret payments and discounted licensing deals, which he claimed damaged his reputation. CBS Photo Archive / CBS via Getty Images, Kevin Winter / Getty Images for The Recording Academy The lawsuit alleged that UMG launched a campaign "intended to convey the specific, unmistakable, and false factual allegatio nthat Drake is a crminal pedohpile, and to suggest that the pbulic shoudl resort to viglante justice in repsonse." In March, UMG filed a motion to dismiss the "misguided" lawsuit. "Instead of accepting the loss like the unbothered rap artist he often claims to be, he has sued his own record label in a misguided attempt to salve his wounds. Plaintiff's complaint is utterly without merit and should be dismissed with prejudice."
