On January 14, a hearing was held in the divorce brought by Smokoff against Robert, who remains behind bars over alleged assault and trespassing accusations. Robert did not appear in court. The court granted Smokoff a default divorce decree. The docs state the exes did not have children or any marital property. The settlement states that both parties are capable of earning money and neither will be awarded alimony. Robert was slow to recognize and accept his marriage was over and continued to connect with his soon-to-be ex-wife. In November 2025, Robert pleaded guilty to trespassing and assault following a series of incidents with his ex-wife and her father. He was also accused of violating a protective order. Prosecutors dropped several other charges, per a deal. The court declined to release Robert from jail and ordered him to remain behind bars until his sentencing in February. "The arrested person has previously been notified by both his wife and the owner of the home that he was not welcome at the residence; both individuals showed me text message conversations which indicated he was not allowed in the home, which the arrested person had responded to in acknowledgment," per official documents. Smokoff's family claimed Robert entered the home through a dog door and then went into Smokoff's bedroom, "causing her to fear for her safety, where he remained despite him being asked to leave." "As the arrested person entered into a dwelling despite being told he was not welcome in the residence and remained inside of said dwelling which caused his wife to fear for her safety, he was placed under arrest for criminal trespass of a dwelling, with a domestic violence enhancement," an officer wrote.
